The Theory of Kafā'ah: A Juristic Review in the Context of Contemporary Social Deviations

Abstract

Kafa'at refers to a concept in Islamic jurisprudence that represents the idea of equivalence and closeness between a prospective husband and wife. It can be described as the compatibility or equivalency necessary between the future spouses, which should be upheld moving forward. This standard of compatibility put forth by Islam is quite impactful and encompasses factors such as religion, profession, wealth, lineage, and moral and social values. Making the marriage relationship enjoyable, enduring, and cohesive is the main goal of this Kafa'at. But unfortunately, in the modern era, the theory of Kafa'at has taken the form of a delicate balance with religious guidance on one side and worldly priorities on the other. Instead of a balanced Sharia principle, people have made Kafa'at a means of social pressure, family ego and personal interests, due to which lineage, caste, community, beauty, class difference, financial status, profession and family prestige are exaggerated to such an extent that a simple and easy Islamic act like marriage becomes difficult. It has become common to reject suitable and righteous relationships in the name of non-Kafu, unnecessary scrutiny, long delays and sometimes making girls wait longer just because they do not meet economic or family standards. This article not only explains the position of the four Imams regarding the ideology of kufa but also provides a detailed analysis of the opinions of contemporary scholars. including Maulana Abul Aʿla Maududi, Shaykh Ibn Bāz, Maulana Muhammad Taqi Usmani, Maulana Ashraf Ali Thanwi, and other scholars.
