Abstract

Objective-based Jurisprudence gains its authenticity and legitimacy from the Holy Quran and the Prophetic Sunnah so the reader finds a lot of glorious legal texts which call for the need that the implementation of these rules should be based on guided insight and that this implementation should achieve the objectives of the Law Giver, as well the objectives of Shariah. The objective-Based implementation in dealing with Prophetic Sunnah regarding the aspect of Jurisprudence and revelation, is one of the fundamental methods of Ijtihad, which gets its authenticity from the Holy Quran and Hadith. The jurists and scholars of Ummah have exercised it in their various Fatwas and interpretations.

The objectives were originated with the emergence of rules that were explained and preached by the Prophet (SAW). The objectives of Shariah was one of considerations and foundations in the process of understanding and derivation of rules, whether issued by the word or action of the Prophet (SAW) himself or those actions and words of his companions that got his approval, acknowledgement and confirmation.

The Companions of the Prophet (SAW) demonstrated, during their dealing with the texts of the prophetic Sunnah, that one should not be bound by the texts with changing times and circumstances and that the rules change with the change in conditions, times and environments. This is evident in their various rulings with the change of conditions as they did not bind themselves with the literal aspects of the text.
